Introduction


The Privacy Policy describes how Opinions Market Research process Personal Data in the context of online panel communities, surveys, reward programs, portal and website (collectively the “Panel Membership”). It describes the types of Personal Data we collect in connection with Panel Membership, the purposes for which we collect that Personal Data, the other parties with whom we may share it, and the measures we take to protect the security of the data. It also tells you about your rights and choices with respect to your Personal Data, and how you can contact us to update your contact information or ask questions about our privacy practices. Registration with, use of, and access to the Panel Membership is subject to this Privacy Policy and our Terms and Conditions.

What is personal data?


“Personal Data” is any information relating to an identified or identifiable natural person (“Data Subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier such as a user IP addresses or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person and includes Special Categories of Personal Data;
“Special Categories of Personal Data” is any Personal Data that reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership; genetic data or biometric data and data concerning health or sex life and sexual orientation.

What personal data is collected and processed?


We ask you to provide certain Personal Data when you register for an account through our website, including your name, address, email address, phone number, date of birth, occupation, education, and gender.

We collect Personal Data you provide in the context of a panel, when you participate in a survey or focus group, in connection with the receipt and redemption of rewards and incentives. Such information includes a unique panellist/respondent identification number we assign to you when you sign up for an account and the responses you provide when completing the survey. In this context, you may choose to provide sensitive Personal Data about yourself, such as Personal Data that discloses or reveals health and medical conditions, sexual orientation or sexual life, political opinions/views, race/ethnic origin, religious and philosophical beliefs and trade-union membership. Where required by law, we obtain your explicit consent to the processing of your sensitive Personal Data.

When you participate in our research, we may ask you for your personal opinions, as well as demographic information, such as your age and household composition. Your location is shared through your IP address. We may also collect content that you submit or upload when participating in a survey, such as photos and video. You may refuse to answer certain questions or discontinue participation in a study at any time.

Why is it being collected/how will it be used?


When Opinions Market Research conducts online research, our invitations and questionnaires clearly identify us and explain the purpose(s) of our contact. When we contact you, we generally do so for one of the following purposes:

1.To invite you to participate in the survey research (including surveys, polls and focus groups)
2.To conduct a research interview with you
3.To validate answers you gave in a recent survey we conducted
4.To ensure that our records of your personal information are correct
5. To send you updates about the community

Occasionally, we may contact you for one of the other purposes:

1.To notify you if you have won a prize draw that we sponsored (if a relevant incentive);
2.To ask for your permission to use your personal information for a purpose that was not explained to you when we first collected your personal information.

If you join our online research panel, you may rescind your membership at any time by following the opt-out instructions that we include in every e-mail that we send. We never knowingly invite children under the age of 16 to participate in research studies without taking measures to ensure appropriate parental consent.

Confidentiality of survey responses and contact information


We will never intentionally report your individual survey responses, except as described below. Your survey responses may be collected, stored or processed by our affiliated companies or non-affiliated service providers, both within and outside Ireland. They are contractually bound to keep any information they collect and disclose to us or we collect and disclose to them confidential and must protect it with security standards and practices that are equivalent to our own.

In addition to keeping your survey responses confidential, we will never sell, share, rent or otherwise intentionally transfer your name, address, telephone number or e-mail address to our clients, other market research companies, direct marketing companies or anyone else.

The only exceptions when we may disclose your personal information or survey responses to third parties are as follows:

1.You request or consent to sharing your identifying information and individual responses with the third parties for a specified purpose;
2.In accordance with the ESOMAR guidelines, we provide your responses to a third party who is contractually bound to keep the information disclosed confidential and use it only for research or statistical purposes;
3.In the rare but possible circumstance that the information is subject to disclosure pursuant to judicial or other government subpoenas, warrants, orders or for similar legal or regulatory requirements.

Who will it be shared with?


We may also share your personal information and/or social-demographic information, including, without limitation, a unique identification number (“ID”), postal code, gender, marital status, education, ethnicity/race (where permitted by applicable law), employment related information, and non-personally identifiable information on household members, with third party sample/market research companies (individually each a “Third Party MR Company” and collectively the “Third Party MR Companies”) for the purpose of identifying survey opportunities that you may be eligible for through the Third Party MR Companies. If you are eligible for a survey opportunity, the Third Party MR Company will provide your unique identification number and a survey link to us and we will invite you to participate in the survey. We will not share your name, email address, or phone number with the Third Party MR Companies.

In connection with the sharing of your information with a Third Party MR Company, your information may be transferred and stored outside of your country of residence, including, without limitation, in the United States. If you have any questions about this data sharing please contact Opinions.ie using the details below or alternatively you can opt-out at any time. Your participation in such survey opportunities does not entitle you to any benefits offered by, or membership with, the Third Party MR Companies.

Data Retention


We maintain appropriate technical, administrative, and physical safeguards to protect Personal Data and other information disclosed or collected by us against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. We will review, monitor, and evaluate our privacy practices and protection systems on a regular basis. We also take measures to delete your Personal Data or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it, unless we are required by law to keep this information for a longer period.

Unsubscription and Termination


If you join our panel, you may rescind your membership at any time by sending blank e-mail with the subject ‘remove me’ to [email protected] or following the opt-out instructions that we include in every e-mail that we send. We never knowingly invite children under the age of 16 to participate in research studies without taking measures to ensure appropriate parental consent.

Opinions.ie will terminate any account in its sole discretion if a member has been inactive for a period of twenty four (24) months. A member will be defined as inactive based lack of Opinions.ie’s Points accrual or redemption. When the account has been terminated, all Opinions.ie Points earned shall be forfeited and all personal data will be erased from any Opinions.ie databases.


Information about transferring data outside of the EEA


Your Personal Data may be transferred to the United States where our survey platforms QuestionPro and SurveyGizmo is headquartered. When we transfer your Personal Data, we will protect that information as described in this Privacy Policy or as disclosed to you at the time of the collection. In case of personal data transfers outside the EEA through our survey platforms Question Pro and SurveyGizmo, we have carried out an assessment to ensure an adequate protection for personal data relating to EU citizens. In such cases, we will use approved controls (e.g. a Data Processing Agreement) to ensure we protect your data privacy to the best of our ability, and ensure third parties who may process your data on our behalf meet the highest standards of privacy practices.

Cookies


Use of cookies, log files and other technologies on our website. Cookies are small text files stored on your computer by a website that assigns a numerical user ID and stores certain information about your online browsing. We use cookies on our survey site to help us provide you a better experience and to provide quality control and validation functions. No personal information is stored on any cookie that we use. We use cookies for the following purposes:
a) Authentication – we use cookies to identify you when you visit our survey site
b) Status – we use cookies to help us determine if you are logged into our survey site
c) Personalisation – we use cookies to store information
d) Security – we use cookies as an element of security measures used to protect user accounts, including preventing fraudulent use of login credentials

Your Rights


Subject to applicable law, you may have the right to:
• Opt out of certain collection and use of your Personal Data when we provide the Panel Membership. For more information, please log into your account and change your preferences.
• You can exercise your choice regarding the use of cookies. Your browser may tell you how to be notified of an opt-out of having certain types of cookies placed on your device. Note that without certain cookies you may not be able to use all of the features of our portal (refer to Cookies paragraph on this document).
• Request access to and receive information about the Personal Data we maintain about you, to update and correct inaccuracies in your Personal Data, to restrict or to object to the processing of your Personal Data, to have the information anonymized or deleted, as appropriate, or to exercise your right to data portability to easily transfer information to another company. In addition, you may also have the right to lodge a complaint with a supervisory authority.
• Withdraw any consent you previously provided regarding the processing of your Personal Data, at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before your consent withdrawal.
Those rights may be limited in some circumstances by local law requirements.
You can stop all collection of Personal Data and other information by us terminating your panel subscription at any time. You may use the standard uninstall processes available through your panellist account on the panel site.
